Mr. Toney earned a Bachelor of Science degree (with Honors) from the University of Alabama. He graduated with Highest Honors from the Norwich Law School, one of England's leading law schools. Mr. Toney earned an advanced degree from the Faculty of Law, University of Oxford, where he specialized in comparative legal methods and criminal procedure. While at Oxford, Mr. Toney was a member of Corpus Christi College. He was a Visiting Lecturer at the Norwich Law School and in the Faculty of Law, University of Trier, Germany. Mr. Toney was an officer in the U.S. Army Reserve.
Mr. Toney has successfully represented clients in a wide range of military and administrative law procedures. Mr. Toney has particular interest and experience in the areas of officer and enlisted promotions, discrimination, investigations, Don't Ask, Don't Tell, administrative separations, physical disability evaluations, discharge upgrades, and the correction of military records. He also provides aggressive representation for military personnel and former military personnel requiring emergency and non-emergency federal court action. He has a number of active federal court cases involving the violation of military regulations, federal statutes, the Privacy Act, and the U.S. Constitution. Mr. Toney has been a strong advocate for the rights of military personnel for 14 years. Mr. Toney also has successfully represented federal employees facing removal, suspension, whistleblower reprisal, and challenges to medical privileges. Mr. Toney is experienced in representing federal employees before the EEOC and the MSPB and has active cases before those boards. Mr. Toney also represents military and civilian personnel requiring assistance in obtaining or maintaining national security clearances.
Mr. Toney, a member of the New York Bar, is admitted to practice in all New York state courts; the U.S. District Court for the Southern District of New York; the U.S. District Court for the Eastern District of New York; the U.S. District Court for the Western District of New York; the U.S. Court of Appeals for the Second Circuit; the U.S. District Court for the District of Columbia; the U.S. Court of Appeals for the D.C. Circuit; and the U.S. Court of Federal Claims. Mr. Toney may appear by permission of the court in federal proceedings throughout the United States. Mr. Toney is active in several law associations. He is a member of the New York State Bar Association; the New York County Lawyer's Association; the National Employment Lawyers Association; the Bar Association of the District of Columbia; the New York Civil Liberties Union; the American Civil Liberties Union; the American Association of Jewish Lawyers and Jurists; and the Federal Bar Association. Mr. Toney also is a member of the International Society for Trauma Studies.
